EIA GUIDELINES AND APPLICABLE LAWS
Environmental Impact Assessments are conducted all over the world to identify the potential negative and positive impacts
of a proposed project, and to recommend mitigation measures to avoid or reduce potential negative impacts and enhance
positive impacts. Almost every country has its own EIA guidelines and laws or regulations. There are also many generic EIA
guidelines available internationally so remember to look under the International, Africa, SADC or other country categories,
especially for South Africa.

Environmental Impact Assessment, audits and monitoring - To develop a system and guidelines for environmental impact
assessment (EIA), audits, monitoring, and evaluation so that adverse environmental impacts can be eliminated or mitigated
and environmental benefits enhanced.

The purpose of these Guidelines for Environmental Impact Assessment (EIA) in Malawi is to facilitate compliance with
Malawi's EIA requirements by Government, project developers, donors and the general public. The guidelines will help to
integrate environmental concerns in national development and will be applicable to all types of projects, in the public and
private sectors, for which EIA studies may be or are required. It is expected that sectoral guidelines for specific types of
projects (e.g. dams, roads, industrial parks) will be produced in due course by the responsible line agencies and donors in
consultation with the Environmental Affairs Department.
Chapter1
- EIA Process, Roles and Responsibilities, Malawi
The EIA process is managed by the Director of Environmental Affairs, Environmental Affairs Department. EIA requirements
apply to both public and private-sector development projects, which are, prescribed under Section 24 of the Environmental
Management Act (EMA) and listed in Appendix B of these guidelines.
As provided for in Section 26 of the EMA, a prescribed project cannot receive the required authorization to proceed from
the relevant licensing authorities unless and until the Director has issued a certificate stating that an EIA is not required
or, on the basis of an EIA report he/she has approved the project. Under the EMA, the Director is empowered to require changes
to a project to reduce its environmental impact and to reject a project if, in his/her view, it will cause significant and
irreparable injury to the environment. Decisions of the Director may be appealed to the Environmental Appeals Tribunal (EAT),
established under Section 70 of the EMA.

- Integrating EIA into Existing Project Planning and Approval process, Malawi
The planning, evaluation and approval of public-sector projects in Malawi is administered by the National Economic
Council. NEC's Project Planning Manual identifies a number of key stages in their approval process. Although the need to
examine environmental impacts is indicated, clear guidelines and procedures for doing so are absent. Thus, it is vital that
NEC's approval process and the EIA process be effectively integrated so that EIA contribute materially to the development of
public-sector projects without hindering the approval process.

- ZERO Regional Environment Organisation is a Non-Governmental Organisation (NGO), registered in 1987 to contribute
to environment and development solutions in the Southern African Development Community (SADC) countries. ZERO's Mission is
to promote an enabling policy environment for the rural and urban disadvantaged women, men and youth to enable them to
manage and utilize land and land-based resources to meet their needs in a sustainable manner, through awareness raising,
participatory policy advocacy, sharing of information, and networking with key stakeholders. ZERO Regional Environment
Organisation’s publications unit has published several working/discussion papers, books, special papers, reports, training
manuals and newsletters, including a Civil Society Guide to the Law-Making Process in SADC Countries. These materials are for
sale and focus on land reform, energy, small-scale enterprises, trade and environment, and NGO-advocacy. Some of these
materials focus on Malawi.
ZERO
- Impact assessment using participatory approaches: 'starter pack' and sustainable agriculture in Malawi
This paper is based on a study undertaken as part of the Malawi Starter Pack Evaluation Programme (1999–2000). Focusing
on the concept of ‘sustainable agriculture’, it describes how participatory approaches can be used for impact assessment and
the kind of information that emerges from such an approach. The study explored how farmers themselves perceive the concept
of sustainable agriculture and how this relates to their livelihoods.
